Access to this website and to the related services is offered to you subject to the conditions stated below.

By accessing, browsing, registering on or placing an order through this website, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the website.

These Terms constitute an electronic record under the Information Technology Act, 2000 and the rules made thereunder, and are generated by a computer system. They are a valid and enforceable electronic contract under Section 10A of that Act and do not require any physical or digital signature.

These Terms are to be read together with our Privacy Policy, Shipping Policy and Cancellation, Return & Refund Policy, each of which forms part of these Terms. If you use any current or future Mypacktech service (for example, Wish List, Quick Deals, or a Marketplace facility), you will also be subject to the terms, guidelines and policies applicable to that service. In case of conflict, the specific service terms will prevail for that service only.

1. Your Account

If you use www.mypacktech.com, you are responsible for:

1. Maintaining the confidentiality of your account and password
2. Restricting access to your device
3. All activities that occur under your account

You must notify us immediately if:

1. Your password is compromised
2. You suspect unauthorised use of your account

You must provide accurate, complete and current information and keep your account profile up to date. Providing false information may result in suspension of your account.

Only a person competent to contract under Section 11 of the Indian Contract Act, 1872 may open an account. Personal-use accounts may be used for personal purchases; for purchases in the course of business or trade, you must register a Business Account and furnish a valid GSTIN where applicable.

Mypacktech may, for valid reasons such as breach of these Terms, suspected fraud, non-payment or a requirement of law, and after giving you notice and a fair opportunity to be heard wherever reasonably practicable:

1. Refuse or restrict access to the website
2. Suspend or terminate an account
3. Remove or disable access to content
4. Decline or cancel an order before it is accepted

Where prior notice is not practicable, we will inform you of the action and the reason for it as soon as reasonably possible. Any amount already paid by you for an order that we cancel will be refunded in full in accordance with our Cancellation, Return & Refund Policy.

2. Privacy & Data Protection

Your personal data is collected, processed and stored in accordance with our Privacy Policy and with the Digital Personal Data Protection Act, 2023 and the Information Technology Act, 2000 (including the rules on reasonable security practices). Our Privacy Policy explains:

Withdrawal of consent will not affect the lawfulness of processing carried out before the withdrawal, nor our ability to retain data that we are required by law to retain. If you do not agree with the processing of your information as described in the Privacy Policy, please do not use the website.

3. Nature of the Platform & Sale of Products

Products displayed on Mypacktech.com are, at present, offered and sold directly by GHV Packtech Enterprises. For these products we are the seller, and the contract of sale is between you and us. We are accordingly responsible for those products under the Consumer Protection Act, 2019, the Sale of Goods Act, 1930 and other applicable law, and nothing in these Terms limits that responsibility.

We may, in future, enable third-party sellers to list products on the website. Where a product is offered by a third-party seller, that fact and the seller’s identity and contact details will be clearly displayed on the product page before you place the order. For such listings we will act as a marketplace e-commerce entity under the Consumer Protection (E-Commerce) Rules, 2020, the contract of sale will be between you and that seller, and our liability will be limited accordingly. Until such listings are introduced, every product on this website is sold by us directly.

In relation to every product listed on the website we will display, as required by the Consumer Protection (E-Commerce) Rules, 2020 and the Legal Metrology (Packaged Commodities) Rules, 2011:

1. The total price in a single figure, including all compulsory charges, with taxes, delivery and other charges broken up separately
2. The country of origin of the goods
3. The name and address of the seller and, where applicable, of the manufacturer, packer or importer
4. The net quantity, and the goods’ specifications, dimensions and grade
5. The expected delivery timeline
6. Details of any guarantee or warranty, and the applicable return, refund, exchange and cancellation terms

We will not adopt any unfair trade practice, will not manipulate the price of goods to gain unreasonable profit, and will not discriminate between consumers of the same class.

4. Orders, Pricing, Taxes & Payment

A product listing on the website is an invitation to offer, not an offer. Your order is an offer to purchase. A contract is formed only when we accept your order by issuing an order confirmation or by dispatching the product, whichever is earlier.

If a product is listed at an incorrect price or with incorrect information because of a typographical, technical or pricing error, we may decline or cancel the order even after confirmation, and we will inform you promptly and refund any amount already paid in full. We will not charge you a price higher than the price displayed at the time you placed the order.

All prices are in Indian Rupees. Applicable Goods and Services Tax (GST) will be charged as per law and a valid tax invoice will be issued. Payments are processed through payment gateways regulated by the Reserve Bank of India; we do not store your complete card details on our servers.

Cancellation, return, replacement and refund of orders are governed by our Cancellation, Return & Refund Policy. Refunds due to you will be credited to the original mode of payment within the timelines stated in that policy.

We strive to ensure uninterrupted access. However:

2. Interruptions may occur due to internet limitations

We will try to minimise such disruptions.

6. License for Website Access

GHV Packtech Enterprises grants you a limited, revocable, non-exclusive license to:

7. Your Conduct

You must use the website only for lawful purposes. In particular, and in line with Rule 3(1)(b) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, you must not host, display, upload, publish, transmit or share any information that:

1. Belongs to another person and to which you do not have any right
2. Is obscene, pornographic, paedophilic, invasive of another’s privacy including bodily privacy, insulting or harassing on the basis of gender, or racially or ethnically objectionable
3. Is defamatory, libellous, encourages money laundering or gambling, or is otherwise inconsistent with or contrary to the laws in force
4. Is harmful to a child
5. Infringes any patent, trademark, copyright or other proprietary right
6. Deceives or misleads the addressee about the origin of the message, or knowingly and intentionally communicates any information which is patently false or misleading in nature but may reasonably be perceived as a fact
7. Impersonates another person

We do not publish fabricated reviews, and we do not misrepresent the quality or features of any product. We will not selectively suppress genuine negative reviews. Reviews may be moderated only to remove content that breaches these Terms or the law.

9. Objectionable Content & Takedown

Mypacktech operates on a notice-and-takedown basis. If you believe that any content on the website falls within any of the categories listed in Clause 7 above — for example content that is unlawful, defamatory, obscene, infringing, misleading, harmful to a child, or invasive of privacy — please notify our Grievance Officer using the Notice Form or the contact details in Clause 22.

In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, we will:

1. Acknowledge your complaint within 24 hours of receipt
2. Dispose of the complaint within 15 days of receipt
3. Act on a complaint about content that exposes a person’s private area, shows nudity or a sexual act, or is in the nature of impersonation including artificially morphed images, within 24 hours of receipt
4. Remove or disable access to unlawful content within 36 hours of receiving an order from a court or a notification from the appropriate Government agency

We will preserve records of removed content and the associated information for 180 days for investigation purposes, or for such longer period as a court or authorised agency may require.

10. Copyright & Database Rights

All content on Mypacktech.com — including text, images, graphics, logos, software, and data compilations — is the property of GHV Packtech Enterprises, its affiliates, or its content suppliers and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, the Designs Act, 2000, and applicable international law.

Without our express written consent, you may not:

1. Systematically extract or re-utilise any substantial part of the contents of the website
2. Create or publish your own database that features any substantial part of our content, such as our prices or product listings
3. Copy, reproduce, distribute or commercially exploit any content

11. Intellectual Property Claims

We respect the intellectual property of others. If you believe your intellectual property rights are being infringed on this website, please contact our Grievance Officer using the Notice Form, giving details of the right you own, the allegedly infringing material, its location on the website, and a statement that your complaint is made in good faith.

12. Disclaimer & Limitation of Liability

Nothing in these Terms excludes or limits our liability for:

1. Death or personal injury caused by our negligence
2. Fraud or fraudulent misrepresentation
3. Defective goods or deficiency in service for which we are the seller or service provider
4. Any liability that cannot be excluded or limited under the Consumer Protection Act, 2019 or any other applicable law

Your statutory rights as a consumer are not affected by these Terms.

Subject to the above, and to the maximum extent permitted by law:

1. The website and its content are provided on an “as-is” and “as-available” basis, and we do not warrant that the website will be uninterrupted or error-free
2. We do not warrant the accuracy or completeness of third-party content or of links to external websites
3. Where a product is sold by a third-party seller through the website, we are not responsible for that seller’s acts, omissions, warranties or representations, and the seller remains liable to you under applicable law
4. Our total aggregate liability in respect of any order will not exceed the total amount paid by you for that order

For products sold by us, all applicable warranties, guarantees and conditions implied by the Sale of Goods Act, 1930 and the Consumer Protection Act, 2019 continue to apply in full.

13. Indemnity & Release

You agree to indemnify GHV Packtech Enterprises and its affiliates against claims arising from:

1. Your breach of these Terms
2. Your violation of any law
3. Third-party rights violations

Where a product is supplied by a third-party seller, you release Mypacktech from liability arising out of that seller’s acts or omissions, to the extent permitted by law. This release does not apply to products sold by us.

14. Children & Minors

The website is intended for persons who are 18 years of age or older and who are competent to contract under Section 11 of the Indian Contract Act, 1872.

A minor may use the website only through, and under the supervision of, a parent or lawful guardian, who will be responsible for all activity on the account. In accordance with the Digital Personal Data Protection Act, 2023, we do not knowingly process the personal data of a child without verifiable consent from a parent or lawful guardian, and we do not undertake tracking, behavioural monitoring or targeted advertising directed at children. If we learn that we hold a child’s data without such consent, we will delete it.

15. Other Businesses & Third-Party Links

The website may contain links to, or content from, websites operated by third parties. If and when third-party sellers list products on the website:

1. We do not endorse their offerings
2. We are not responsible for examining or evaluating their content, and we do not warrant their offerings
3. Their identity and contact details will be displayed on the product page
4. You should review their policies before transacting with them

16. Communications

When you use Mypacktech.com you communicate with us electronically, and you consent to receive communications from us by email, SMS, WhatsApp, phone call and website or app notification.

Transactional and service communications relating to your account, orders, delivery, payments, invoices and complaints will be sent to you as a necessary part of the service.

Promotional and marketing communications will be sent only where you have given consent for them. You may withdraw that consent at any time by using the unsubscribe link in any email, by writing to our Grievance Officer, or by changing your notification preferences in your account. We honour registrations under the National Customer Preference Register (DND) and comply with the TRAI Telecom Commercial Communications Customer Preference Regulations, 2018. Withdrawing consent for marketing will not stop transactional communications.

17. Losses

We are not liable for any business losses including:

1. Loss of profit
2. Revenue
3. Data
4. Goodwill
5. Contracts
6. Indirect or consequential damages

18. Alteration of Services or Terms

We may modify the website, our policies and these Terms & Conditions from time to time. The version of the Terms in force at the time you place an order will govern that order. Material changes will be notified on this page with a revised “Last updated” date and, where the change materially affects your rights, by email or notification to your registered contact details. Your continued use of the website after a change takes effect constitutes acceptance of the revised Terms. Changes required by law or by a government authority take effect as required by that law or authority.

19. Events Beyond Our Control (Force Majeure)

We are not liable for any delay or failure to perform our obligations where the delay or failure arises from a cause beyond our reasonable control, including an act of God, flood, fire, earthquake, epidemic or pandemic, war, riot, civil unrest, strike, act of terrorism, failure of public infrastructure or telecommunications, cyber-attack, or an act, order or restriction of any government authority. This clause does not affect your statutory rights, and we will refund amounts paid for any order that we are ultimately unable to fulfil.

20. Waiver & Severability

Our failure or delay in enforcing any provision of these Terms is not a waiver of that provision or of any other right or remedy.

If any provision of these Terms is held to be invalid, void or unenforceable by a court or competent authority, that provision will be severed and the remaining provisions will continue in full force and effect.

These Terms, together with the policies referred to in them, constitute the entire agreement between you and us in relation to your use of the website.

On receipt of a consumer complaint we will:

1. Issue a ticket number and acknowledge the complaint within 48 hours
2. Redress the complaint within one month from the date of receipt
3. For complaints about content, follow the shorter timelines set out in Clause 9

If you are not satisfied with the resolution, you may escalate to the National Consumer Helpline (1915 / consumerhelpline.gov.in), to the appropriate Consumer Commission, or, in respect of personal data, to the Data Protection Board of India.

22. Governing Law, Jurisdiction & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India.

Subject to the paragraph below, the courts at Faridabad, Haryana will have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or your use of the website.

Consumers: nothing in this clause limits your right under Section 34(2)(d) of the Consumer Protection Act, 2019 to institute a complaint before the District, State or National Consumer Disputes Redressal Commission having jurisdiction where you ordinarily reside, work for gain, or carry on business.

Business customers: any dispute that is not resolved through the grievance process in Clause 21 within 30 days may be referred to arbitration by a sole arbitrator appointed by mutual consent, under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration will be Faridabad, Haryana and the language of the proceedings will be English. The arbitral award will be final and binding.
